Setup:
Richard Fish's law firm is representing his friend Jeremy and Jeremy's current boyfriend Alex in a lawsuit brought against them by Jeremy's ex-lover Robert. Alex was Jeremy's first boyfriend. After Alex left Jeremy broken-hearted, Jeremy met Robert and they built a happy and successful life together. Then Alex reappeared and befriended the couple, eventually rekindling a romance with Jeremy. Robert is using the buyout clause on his business with Jeremy to delay Jeremy and Alex's plans to leave town.

Fish is in charge of the case and Ally is second chair. Fish, familiar with Alex and Jeremy's history, is more than a little suspicious of Alex's motives and sincerity.

The judge on the case didn't dismiss Robert's case as Fish and Ally had hoped. An evidentiary hearing is scheduled for the next day, and Robert is scheduled to testify first. Fish, Ally, Jeremy and Alex meet the night before to discuss strategy.

INT. FISH'S OFFICE - NIGHT

Fish, Ally, Jeremy and Alex.


FISH

You know the problem with having Robert on the stand tomorrow?

ALEX

What?

FISH

It's Robert on the stand tomorrow. I don't know much about Robert. Just the Christmas card stuff. Jeremy and Robert move in together. Jeremy and Robert start a business together. Jeremy and Robert, wildly successful. And happy. And then you show up again, Alex.

ALEX

Meaning?

FISH

Meaning I'd know how to cross-examine you.

JEREMY

Richard.

ALLY

Bygones.

ALEX

No, I'd like to hear this.

FISH

I understand your not being too keen on Robert, Alex, I do. After all, he made Jeremy happy for over ten years, not to mention rich, whereas you were just the first guy to break Jeremy's heart, so naturally, Robert makes you look bad.

ALEX

There's a reason you don't know much about Robert. He's a closet case. He's not comfortable, except in private. And Jeremy never pushed it. Most of the outside world thinks they're just business partners and Robert never corrects them.

JEREMY

He was coming around.

ALEX

After ten years in a relationship. Whoa, stand back. Let's give him a medal. He works quick.

FISH

So do you.

JEREMY and ALLY

Richard.

FISH

You better hope this one gets settled before you take the stand because that wouldn't go so well.

ALEX

Jeremy was dying in that relationship. Dying for someone he could really talk to about who he was. That's all we did for the longest time when I found him again, just talked.

FISH

And you found him how? Oh that's right, he was a whole lot easier to spot this time since he was sitting on a big pile of money.

JEREMY

OK, we're done here. At this point, I'd give my share of the company to him for nothing just to be done with this.

ALEX

You'd...?

JEREMY

Of course I would. After everything, how could you doubt...?

ALLY

We'd have to advise against that.

FISH

Gotta' capitalize on those assets, right, Alex?

ALEX

I've got my own company and it's doing very well. I don't want Robert's money.

FISH

Just his husband.

ALEX

Like he'd ever call him that.

Jeremy pulls Alex out of the room.


ALLY

I thought the whole point was to cozy up to them, get a little good word of mouth going.

FISH

Aren't gay men supposed to be nicer - more in touch with their feminine whatevers?

ALLY

They're still men - times two. Do the math.

FISH

Solved one problem, though.

ALLY

Which one?

FISH

I know what to do about Robert.
